Learned counsel for the appellant states that the given situation as it has emerged now is that the appellant(s) are willing to execute the sale deeds if the property is transferred to them on 'as is where is basis'. Learned counsel for the respondent(s) states that the respondents are willing to do the same but they should not be burdened with further claims.
Leaned counsel for the parties agree that they will sit together to negotiate a settlement and to the extent there is some difference of view, if any, they will leave it to the Court to take a call to resolve the issue amicably.
Learned counsel for the respondent also submits that the company has been arrayed as respondent No.2 and has sued through the Managing Director Mr. Ajit Thomas Abraham. He states that since the company is practically defunct and there are restraints on travel of the Managing Director outside the State of Kerala, he will file a Vakalatnama on behalf of the Managing Director.
