UPON hearing counsel the Court made the following

O R D E R

Having regard to the peculiar facts and circumstances of this case, particularly in view of the fact that the question as t o whether the prosecutrix was above the age of 16 years or not being a contentious question, we direct that the appellant shall be released on bail on furnishing bail bonds for a sum of Rs. 10,000/- with one surety of the like amount to the satisfaction of the Sessions Judge,

Latur.

The special leave petition is disposed of with the aforementioned direction.
