UPON hearing the counsel the Court made the following O R D E R

1. In the present case, after referring the matter to mediation, the application for direction for joint survey has been filed by the petitioners, the prayer as made in the said application are as under :-

"a. Direct the Director of survey and Land Records, Directorate of Survey and Land Records, Revenue Department of Pondicherry, Pondicherry, to conduct a joint survey of the entire land in Re-Survey No. 96/1, Thattanchavady Village, Puducherry having a total extent of 3 Kani and 11 Kuzhies as per the documents in Para 11 of this Application relied on by the Petitioners;

b. Direct the Director of Survey and Land Records, Directorate of Survey and Land

Records, Revenue Department of Pondicherry, Pondicherry to conduct a joint survey to identify and fix the boundaries of the land of 51 Kuzhies land in Re-Survey No.96/1, Thattanchavady Village, Puducherry out of the total extent of 3 Kani and 11 Kuzhies as per the documents in para 11(iii)(v) to (viii) of this Application relied on by the Petitioners.

c. Direct the Director of Survey and Land Records, Directorate of Survey and Land Records, Revenue Department of Pondicherry, Pondicherry to conduct a joint survey to identify and fix the boundaries of the land of 52 Kuzhies land in Re-Survey No. 96/1, Thattanchavady Village, Puducherry out of the total extent of 3 Kani and 11 Kuzhies as per the documents in Para 11(iv) of this Application relied on by the Petitioners.

(d) Direct the Director of Survey and Land Records, Directorate of Survey and Land Records, Revenue Department of Pondicherry, Pondicherry, to conduct a joint survey and fix the boundaries of the land to the extent of 2 Kani 8 Kuzi 15 Veesam in Re-Survey No.96/1, Thattanchavady Village, Puducherry as per the documents in Para 12 of this Application relied on by the Respondents No. 1 and 3 to 9."

3. After hearing learned counsel for the parties, we are of the opinion that the survey as prayed would be in fitness of things for both the parties. Therefore, the Director of Survey and Land Records may assign appropriate team for survey as prayed and submit a report within two months.

4. IA for directions is accordingly disposed of.

5. List after the ensuing summer vacation.
