UPON hearing the counsel the Court made the following O R D E R
RE: LARGER ISSUED POSED BY THE HON'BLE COURT
Learned counsel for the State of Bihar submits that they are no more contesting the view taken by the High Court on the administrative side as noticed in the order dated 09.12.2022. This is the second aspect which was flagged in our order dated 23.01.2023. That being the position, the lis qua this aspect does not require to be considered.
Insofar as the infrastructure issue is concerned, a further affidavit has been filed. Apart from that learned Amicus Curiae points out to us that the Patna High Court itself is seized of the issue of infrastructure created by proceedings on the judicial side. It is appropriate that the High Court itself monitors this aspect.
In view of the aforesaid, no further directions are required in the present matter.
The proceedings in the present special leave petition is closed.
