We are satisfied that the petitioner has made out a case for transfer of the case from Gurgaon to Alipore, West Bengal.

We, accordingly, direct that H.M.A. Case No.41 of 2002, tiled Ashish Kumar Goswami Vs. Jhuma G oswami, pending before the District Judge, Gurgaon, shall stand transferred to the District Judge, Alipore, West Bengal. The District Judge on receipt of the record shall either decide the case himself or transfer it to any other competent court of law. The transfer petition is allowed.
