S U P R E M E C O U R T O F I N D I A RECORD OF PROCEEDINGS Petition(s) for Special Leave to Appeal (Crl.) No(s). 979/2021 (Arising out of impugned final judgment and order dated 19-01-2021 in ABLAPL No. 15364/2020 passed by the High Court Of Orissa At Cuttack) CHAVA NEELIMA & ANR. Petitioner(s) VERSUS STATE OF ORISSA & ANR. Respondent(s) (FOR ADMISSION and I.R. ) Date : 26-02-2021 This petition was called on for hearing today. CORAM : HON'BLE MR. JUSTICE SANJAY KISHAN KAUL HON'BLE MR. JUSTICE HEMANT GUPTA For Petitioner(s) Mr. Biswajit Das, Adv.

Mr. Abhigya Kushwah, AOR

For Respondent(s)

Mr. O.P. Gaggar, AOR

UPON hearing the counsel the Court made the following O R D E R

Learned counsel has entered appearance on behalf of respondent No. 2 and states that the OTS period is already over and a fresh OTS will have to be worked out.

So far as the immovable properties are concerned. the learned counsel for respondent No. 2 states that the endeavours made earlier to sell those properties had not been successful.

Unfortunately, the petitioner and respondent No.

1

ITEM NO.32 Court 8 (Video Conferencing) SECTION II-B

2 keep on blaming each other and obviously the present scenario is a reflection of what must have transpired earlier with both the parties. We thus call upon the petitioner to locate suitable buyers for the immovable property and to approach the bank with said proposed buyers and the bank will take a call quickly and not keep the issue pending as their own endeavour to sell the property has not been successful.

A bank will file a progress report before us in eight weeks.

List after eight weeks.

Interim order dated 8.2.2021 to continue till the next date.

It appears that the description of respondent No. 1 is not correct.

As the matter is with the CBI and thus the memo of parties be amended accordingly to implead the CBI as the first respondent. Let the amended memo of parties be filed within three weeks.

Let notice issue to substituted party returnable on the next date.
