INTERLOCUTORY APPLICATION NO. 6 (Application for early hearing) IN CIVIL APPEAL NO. 1646 OF 2012

It is submitted that counsel for the appellant has on 07.04.2014 filed application for early hearing (registered as I.A. No. 6) and the same has been placed with appeal paper books.

It is further submitted that there are 5 respondents in this appeal. Service of Notice of Lodgement of Petition of Appeal is complete on all the respondents. Respondent Nos. 1 and 2 are represented by M/s Vikash Singh and Corporate Law Group, Advocates respectively. No one has entered appearance on behalf of respondent Nos. 3 to 5 so far though served with notice.

Original Record has been received from the High Court and is available with this Registry for reference of this Hon'ble Court.

It is further submitted that application for condonation of delay in filing statement of case by the counsel for the appellant and non filing of statement of case by the counsel for the appearing respondent, was listed before Hon'ble Judge in Chambers on 16.09.2013 with office report for directions, when His Lordship was pleased to pass the following order:

*"*Application for condoning the delay in filing the Statement of Case by the appellant, is ordered. At the request of the counsel for the respondents finally four more weeks time is granted for filing Statement of Case.

After the filing of Statement of Case by the respondents, it is open for the appellants to move the application for early hearing for orders before the Court."

It is further submitted that despite the aforesaid order counsel for respondent Nos. 1 and 2 have not filed statement of case and hence office report for orders was again listed before the Hon'ble Judge in Chambers on 17.02.2014, when His Lordship was pleased to pass the following order:-

"Last opportunity is granted to the learned counsel for the respondents to file statement of case within four weeks."

It is lastly submitted that counsel for respondent No. 2 has on 24.03.2014 filed statement of case and the same has been included in appeal paper books. Counsel for the appellant has already filed statement of case but counsel for the respondent No. 1 has not filed statement of case so far.

The application in the above mentioned is listed before the Hon'ble Court with this Office Report.
