UPON hearing the counsel the Court made the following O R D E R

We are not inclined to issue notice in the present special leave petition but clarify that in case the petitioner does not seek recall of the order dismissing his petition under Section 13 of the Hindu Marriage Act, 1955, he would be liable to pay maintenance under Section 24 of aforesaid Act till the date of the Digitally signed by Anita Malhotra Date: 2022.02.05 12:58:35 IST Reason: Signature Not Verified

impugned order passed by the High Court on 14th December, 2021. The aforesaid observation would not come in the way of the respondent initiating appropriate proceedings claiming maintenance.

Liberty is also granted to the respondent to move an application before this Court in case she feels aggrieved by any direction/observation in this order.

Recording the aforesaid, we dismiss the special leave petition.

Pending application(s), if any, shall stand disposed of.
