The matter above mentioned was listed before the Hon'ble Court 27th January, 2015 when the Court was pleased to pass the following Order:

"Delay condoned. Issue notice. In the meanwhile, there shall be stay of further proceedings in HMP No.478 of 2013 pending before the Court of Principal Judge, Family Court, Surat, Gujarat."

Thereafter, the matter above mentioned was lastly listed before the Court of Registrar on 12th October, 2015 when the following Order was passed:

"Sole respondent has yet not filed the counter affidavit. A perusal of the order dated 10.8.2015 shows that the respondent was already warned with the last opportunity. Further opportunity is, therefore, declined. Petition now be processed to be listed before the Hon'ble Court, as per rules."

It is submitted for the information of the Hon'ble Court that there is sole respondent in the instant matter. Accordingly, show cause notice was issued to the sole respondent by registered A. D. post on 26.02.2015. Mr. Vikas Singh, Advocate has entered appearance on behalf of the sole respondent but he has not filed counter affidavit so far.

The service of notice is complete.
