UPON hearing the counsel the Court made the following O R D E R
We have been informed by the counsel for respondent No. 5-Muhammad Jameel Merchant/ Builder that the petitioners have vacated the area which was occupied by them in building (Savera Terrace) situated at CTS No. 2878A of Village Malvani, Abdul Hamid Marg, Malvani Gate No. 5, Malvani Malad (West), Mumbai 400 064. The counsel for the petitioner further submitted that the respondent No. 5-Builder has not been provided any transit accommodation and they have no place to shift to till the building is re-constructed.
The petitioners seek liberty to move an application for the said relief before the Bombay High Court in the pending Writ Petition being Writ Petition No. 852 of 2020. In the event of such an application being filed, it would be decided in accordance with law.
With these observations, we dispose of the special leave petitions. Pending application stands disposed of.
