The matter abovementioned was listed before the Hon'ble Court on 15th January, 2015, when the Court was pleased to pass the following order:
"On instruction from the DirectorMr. Vineet Kumar Dujodwala, one of the accused directors, the learned counsel appearing on behalf of the petitioner submits that the petitioner will pay the principal amount of Rs.1.55 Crores within four weeks.
In view of such submission, we allow the petitioner/Company to pay the amount to the Sales Tax Department, Government of Maharashtra within the aforesaid period.
Let notice be issued on respondents as to why anticipatory bail be not granted in favour of the petitioner, returnable within four weeks.
Dasti, in addition, is permitted.
Petitioner may serve a copy of the paper book on the Standing Counsel for the State of Maharashtra.
In the meantime, the petitionerGanesh Mane be not taken into the custody in connection with F.I.R. No. 159/2012, dated 31.01.2012 registered as Crime No. 17/2012, Police Station: Cuffe Parade, Mazgaon, Mumbai.
The petitioner shall cooperate with the police/investigating officer in the matter of investigation."
Accordingly, show cause notice was issued to all the 3 respondents through speed post as well as by dasti mode.
It is submitted that Mr. A.P. Mayee, Advocate has filed vakalatnama/ appearance on behalf of respondent No.1 (State). Mr. Dinesh Kumar Garg, Advocate has filed affidavit of service with proof of service after serving dasti notice on respondent No.1 (State( only. Regarding respondent nos. 2 & 3, it is submitted that they have filed Special Leave Petitions before the Hon'ble Court which have been tagged with the Special Leave Petition, hence there is no need to serve these respondents. The counsel has also served a copy of Special Leave Petition on Mr. A.P. Mayee (standing counsel for the State of Maharashtra).
It is further submitted that as per India Post delivery report, the show cause notice has been served on all the three respondents in the matter.
It is lastly submitted that Mr. Dinesh Kumar Garg, Advocate has not filed proof of depositing the principal amount of Rs. 1.55 crores, so far. However, he has filed an application for modification of Court's Order dated 15th January, 2015 and the same has been registered as Criminal Miscellaneous Petition No. 2718 of 2015. The aforesaid application is being circulated to the Hon'ble Court.
The matter abovementioned is, therefore, listed before the Hon'ble Court with this Office Report.
