PETITION FOR SPECIAL LEAVE TO APPEAL (CIVIL) Nos. 5395-5399 OF 2016

The matters above mentioned have been filed on 8 th January, 2016 against the common final Judgment and Order dated 8th July, 2015 passed by the High Court of Judicature at Madras, in W.A. Nos. 2073 and 1605 of 2013, W. P. Nos. 3035 and 33869 of 2013 and W.A. No. 291 of 2013 but the same were defective. After curing the defects, Counsel for the Petitioner has re-filed the Petition which is barred by time by 14 days and Counsel for the Petitioner has filed an application for condonation of delay in re-filing the Special Leave Petition and the same has been condoned by the Additional Registrar on 22nd February, 2016.

It is submitted that Special Leave Petition(C) No.26775 of 2013 @ SLP(C)...CC No. 14007 of 2013 entitled "Secretary to Govt.,Spl. Implemen. Dept &Ors.-Vs- M. A. Abdul Samad & Ors." @ similar issue was listed before the Hon'ble Court on 21st August, 2013 when the Court was pleased to dismiss the same. Copy of the Record of proceedings dated 21st August, 2013 is circulated herewith.

It is further submitted that Special Leave Petition(C) 24038-24040 of 2013 @ SLP(C)....CC Nos. 12886-12888 of 2013 entitled "The Forest Ex. Officer Ponnakudi & Etc.-Vs- M. Balakrishnan & Ors. Etc." were listed before the Hon'ble Court on 19th July, 2013 when the Court was pleased to dismiss the same on the ground of delay. Copy of the order has already been placed as Annexure P-13 at page nos. 444-445 in the Special Leave Petition paper books.

It is submitted that Special Leave Petition(C) No. 35969 of 2009 entitled "State of Tamil Nadu -Vs- V. Mariappan &Ors." referred to Annexure P-19 was listed before the Hon'ble Court on 25th February, 2015 when the Court was pleased to dismiss the same. Copy of the order has already been placed as Annexure P-19 at page nos. 502-504 in the Special Leave Petition paper books.

PETITION FOR SPECIAL LEAVE TO APPEAL (CIVIL) Nos. 5391-5393 OF 2016

The matters above mentioned have been filed on 8 th January, 2016 against the common final Judgment and Order dated 8th July, 2015 passed by the High Court of Judicature at Madras, in W.A. No. 2541 of 2013, W. P. Nos. 30335 of 2013, 5597 of 2014 but the same were defective. After curing the defects, Counsel for the Petitioner has re-filed the Petition which is barred by time by 14 days and Counsel for the Petitioner has filed an application for condonation of delay in re-filing the Special Leave Petition and the same has been condoned by the Additional Registrar on 22nd February, 2016.

It is further submitted that Counsel for the Petitioner has on 19th February, 2016 filed a letter stating therein that orders dated 23rd April, 2012, 26th November, 2010, 7th June, 2012, 22nd April, 2013, 30th November, 2010, 19th January, 2011, 18th April, 2012, 17th September, 2012, 26th November, 2012, 31st March, 2015 and W.A. No. 2541 of 2013 are not necessary to be filed presently in the subject matters as the aforesaid orders filed in their respective SLPs of identical matters against the same/common impugned judgment and order. Copy of the Advocate's letter dated 19th February, 2016 is placed at page No. 444 of the Special Leave Petition Paper books.

It is further submitted that the instant matter and Special Leave Petition(C) Nos. 5395-5399 of 2016 are arising out of common order.

PETITION FOR SPECIAL LEAVE TO APPEAL (CIVIL) Nos. 5367-5375 OF 2016

The matters above mentioned have been filed on 8 th January, 2016 against the common final Judgment and Order dated 8th July, 2015 passed by the High Court of Judicature at Madras, in W.A. Nos. 1398 and 1932 of 2013, W. P. Nos. 33862 of 2013, 355 of 2014, 356 of 2014, 30319 of 2013, 29969 of 2013, 30047 of 2013 and 30081 of 2013 but the same were defective. After curing the defects, Counsel for the Petitioner has re-filed the Petition which is barred by time by 13 days and Counsel for the Petitioner has filed an application for condonation of delay in re-filing the Special Leave Petition and the same has been condoned by the Additional Registrar on 22nd February, 2016.
