However, we are not sure whether the affidavit has been filed before the High Court because we had issued notice on account of the fact that the State was not taking a stand before the High Court and it is for the High Court to bestow consideration on the matter.

Learned counsel for the State submits that she will obtain instructions whether counter affidavit was filed before the High Court or not, if not filed, how much time will they take to file the counter affidavit.
