The matter abovementioned was listed before the Ld. Registrar's Court on 31.07.2015 when the Ld. Registrar was pleased to pass the following order:

"SLP(C) No. 5023/2015

Among three respondents herein, respondent No.1 is yet not served. The Ld. Counsel for the petitioner to take fresh steps to effect service. Service can be effected through the standing counsel of the respondent – State.

Counter affidavit of respondent Nos.2 and 3 is awaited. Be filed within four weeks' time, as last opportunity.

Legal representatives of the deceased sole petitioner have already been brought on record vide order dated 11.6.2015. Registry to amend the cause title.

Among 57 respondents herein, counter affidavit of respondent Nos.1 and 2 is awaited. Be filed within four weeks' time, as last opportunity.

Respondent Nos.28, 30, 33, 34, 44, 47, 53 and 57 have refused to receive the service.

Respondent Nos.31, 37, 41 and 55 are reported to have expired. Petitioner to take steps to substitute the respective legal representatives.

With respect to the remaining unserved respondents, the Ld. Counsel for the petitioner to take fresh steps with furnishing the fresh and complete address of respondent Nos.46 and 52. Notice

thereafter be issued. List again on 8.10.2015."

There are three respondents in this matter.

Mr. Samir Ali Khan, Advocate has on 11.09.2015 filed vakalatnama on behalf of respondent no.1 but he has not filed counteraffidavit, so far.

It is submitted that counsel for respondent nos.2,3 have not filed their counteraffidavit,so far.

It is further submitted that the Lrs. Of deceased petitioner have been brought on record and Cause Title has been amended.

Service of show cause notice is complete.

It is submitted that AD card duly signed from respondent no.2 has been received back.

It is further submitted that counsel for the petitioner has on 07.09.2015 filed spare copies and instead of filing fresh addresses of respondent nos.46 and 52, counsel has on 30.09.2015 filed a letter stating therein that he will file application for deletion of respondent nos.46 and 52 but he has not filed application for deletion of respondent nos.46 and 52, so far.

Accordingly show cause notice was issued on 03.10.2015 to respondent nos.319,2325,27,29, 32, 35, 36, 38, 39, 40,42,43,4851,54,56 and service of show cause notice yet awaited.

It is lastly submitted that counsel has not taken steps to

bring on record the Lrs. Of deceased respondent nos.31,37,41 and 55, so far.

Service on remaining respondents is complete but no counteraffidavit has been filed, so far.

The matters are listed before the Hon'ble Court with this Office Report.
