UPON hearing the counsel the Court made the following O R D E R

Delay condoned.

After hearing learned counsel, we were inclined to restore the sentence imposed by the trial Court.

Learned counsel for the petitioner then made a fervent request, that he may be permitted to withdraw the petition, as he would not like to press the same. Despite our view to the contrary, in the peculiar facts and circumstances of the case, we are of the view, that the prayer made by the learned counsel should be accepted. Accordingly, the instant petition is dismissed as not pressed.
