The Special Leave Petition (Civil) No. 37283 of 2013 was listed before the Hon'ble Court on 27th January, 2014 when the Court was pleased to pass the following Order:

"Since both parties are aggrieved by the impugned Judgment and also having regard to the findings recorded by the High Court, we are of the view that the special leave petition requires consideration. Leave granted. Hearing expedited. Counter affidavit, may be filed by the contesting respondents within four weeks. Rejoinder, if any, may be filed by the appellants within two weeks As regards prayer for interim relief, list the matter after six weeks."

It is submitted for the information of the Hon'ble Court that Mr. Chirag M. Shroff and Mr. Subramonium Prasad, Advocates have filed separate application for impleadment to implead the applicants as party respondent in the matter above mentioned and they have also filed vakalatnama/appearance on behalf of the proposed respondents. The applications are registered as Interlocutory Application Nos. 3 and 5.

It is further submitted that there are seventy one respondents in this matter. Ms. Diksha Rai, Advocate has entered appearance alongwith counter affidavit on behalf of Respondent Nos. 2 to 4. Mr. Vikash Singh, Advocate has entered appearance along with

counter affidavit on behalf of Respondent No. 5. Mr. Rashmi Kumar Manilal, Vithlani, Advocate has entered appearance on behalf of Respondent Nos. 6, 7, 9 to 21, 23, 24, 26 to 30 and 32 to 33 but he has not filed counter affidavit so far.

It is again submitted that Mr. P. J. Malkan, Advocate has filed affidavit in rejoinder to the counter affidavit filed by Respondent No. 1 and the same is included in the paper books.

Service on Respondent Nos. 1, 8, 22, 25 and 3471 is incomplete as certificate of service is awaited form the High Court.

Original record is awaited.

The application in the appeal above mentioned is listed before the Hon'ble Judge in Chambers for Orders with this office report.
