UPON hearing counsel the Court made the following O R D E R
By our order dated 2nd May, 2005, we have directed the appellant to deposit 50% of the demand in regard to all the disputed years. We also directed the amount already deposited should be given credit. Today learned counsel for the petitioner brings to our notice that this directi on to deposit, in question, was made with a view to stay recovery of memo of excess 50% but th e same is not recorded. We think the learned counsel is right in his submission. Subject to the deposit of 50% of the demand, we stay the balance of recovery.
