the impugned judgment is allowed.

Learned counsel for the petitioner contends that effectively, the charge against the respondent No.1 is that he conveyed an impression as if sanction from the VC was accorded while actually it was not so. There can be no dispute, in our view, of the urgent requirement of hostel accommodation and the only question is what is the process which is required to be

followed for determining the returns to the owner who were wanting a higher amount.

We would require the petitioners to produce the original record duly flagged so far as the process which took place in the meantime including the records of the search committee.

Issue notice.

The caveater is present for respondent No.1 and accepts notice. In the meantime, respondent No.1 may file the counter affidavit setting forth the stand of the said respondent.

Respondent No.2, at the oral request of the petitioner, is deleted from the array of parties.

Amended memo of parties be filed within a week. Counter affidavit be filed within four weeks. Rejoinder be filed within two weeks thereafter.

List after eight weeks when the records will also be placed before us.
