1. Appellant has preferred this appeal aggrieved by order dated 27.03.2018 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases, Bharatpur, Rajasthan whereby, bail application under Section 439 Cr.P.C. filed by the appellant was rejected.

2. F.I.R. No. 06/2017 was registered at Police Station Gadhibajna, District Bharatpur for offence under Sections 143, 323, 427, 307 of I.P.C. and Sections 3(2)(V) of SC/ST (Prevention of Atrocities) Act.

3. It is contended by counsel for the appellant that appellant is not named in the F.I.R. Appeal of co-accused have been allowed by this Court and by Co-ordinate Benches of this Court.

4. Learned Public Prosecutor has opposed the appeal.

5. I have considered the contentions.

6. Considering the contentions put forth by counsel for the appellant, I deem it proper to allow the appeal.

7. The order dated 27.03.2018 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases, Bharatpur, Rajasthan, is quashed and set-aside and this appeal is accordingly allowed and it is directed that accused appellant shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
