Application is allowed for the reasons stated therein, the word "since deceased" is ordered to be inserted against the name of proforma respondent No. 2 Ratan Kunwar.

Learned counsel for the appellants submits that the proforma respondent No. 2 Ratan Kunwar died on 21.12.2022. So, name of proforma respondent No. 2 Ratan Kunwar be deleted.

Application is allowed for the reasons stated therein the word "since deceased" is ordered to be inserted against the name of proforma respondent No. 2 Ratan Kunwar.

Amended cause title filed with application is taken on record. List after four weeks.

Meanwhile, office is directed to procure the status report of the suit from the concerned trial Court.
