Learned counsel for appellant requests for time.
An application (IA No. 1/2021) under Order 22, Rule-10-A of CPC was filed on 04.03.2021 intimating death of respondent no.1 on 12.10.2020.
Considered aforesaid.
This appeal is preferred against sole respondent and we are after three years of death of sole respondent.
Hence, the appeal stands abated as no steps were taken to implead legal representatives of respondent.
The appeal is dismissed in abatement.
Misc. application, if any, stands disposed of.
