1. Heard learned counsel for the petitioner through video conferencing. Learned Public Prosecutor is present in person in the Court.

2. Petitioner has filed this bail application under Section 439 of Cr.P.C.

3. F.I.R. No. 345/2019 was registered at Police Station Chirawa District Jhunjhunu for offence under Sections 363 & 366 of I.P.C.

4. No ground is made out for entertaining the bail application at this stage, as prosecutrix is a child, who in her statement has levelled allegations with regard to rape against the petitioner.

5. Criminal Miscellaneous Bail Application is accordingly rejected.

6. Petitioner would be free to move fresh bail application after recording of the statement of prosecutrix in Court.
