Office has pointed out that there is a delay of 63 days in filing the present second appeal for which separate application No. 873/2013 has been filed seeking condonation of delay under Section 5 of the Limitation Act.

After hearing counsel for the appellant, this court is satisfied that the delay has been satisfactorily explained, duly supported by affidavit.

Accordingly, the application seeking condonation of delay u/Sec. 5 of Limitation Act stands allowed and the delay is condoned.
