This matter has come-up on an Application (IA No. 2/2021) filed under Order 22 Rule 10-A of CPC praying that the fact of death of Respondent-Prahlad Sharma may be taken on record. He has expired on 17.11.2020.

There is another application (IA No. 1/2021) filed under Order 22 Rule 4 and 9 of CPC read with Section 5 of the Limitation Act.

It has been submitted that the sole respondent-Prahlad Sharma has expired on 17.11.2020. He has left behind his Legal Representatives whose details are given in Para-1 of the application. Hence, it is prayed that they may be substituted in place of deceased Respondent-Prahlad Sharma.

Looking to the submissions made by the parties, application (IA No. 1/2021) is allowed.

Amended cause title be taken on record. Office is directed to proceed accordingly.
