In wake of second surge in the COVID-19 cases, abundant caution is being maintained, while hearing the matters in Court, for the safety of all concerned.
After arguing for some time, counsel for the petitioner does not want to press this petition but seeks liberty to move parole application afresh for a period of seven days in accordance with Rule 18 of the Rajasthan Prisoners Release on Parole Rules, 1958.
Permission granted.
The instant criminal writ petition is dismissed as withdrawn with the aforesaid liberty.
Needless to say that the respondents if deems it appropriate may grant benefit of parole to the petitioner of seven days under Rule 18 of the Rules in-question and then only the petitioner will be entitled move application again for permanent parole, however, each of the paroles shall be decided strictly in accordance with law.
