Petitioner Namrata in the present petition under Section 24 of the Civil Procedure Code is seeking the transfer of petition under Section 12 of the Hindu Marriage Act, 1955 (for short the 1955 Act) for annulment of the marriage pending before the learned Addl. District Judge, Jalandhar to a court of competent jurisdiction either at Hisar or Fatehabad.
Upon notice, the respondent-Amardeep Singh has put in appearance through Mr. M.S. Sachdev, Advocate who submits that in view of the conceded fact that the petitioner Namrata is presently employed and residing at Manimajra, Chandigarh, they would have no objection if the aforesaid petition is ordered to be transferred to a court of competent jurisdiction at Chandgiarh instead of any court at Hisar or Fatehabad.
In response, the learned counsel for the petitioner on instructions from petitioner-Namrata who is present in court submits that they accept the aforesaid offer.
Accordingly, in view of the aforesaid agreed stand the present transfer application is allowed and the HMA Case No.40027-4201 dated 3.11.2010 titled Namrata Vs. Amardeep T.A. 442 of 2012 2
Singh is ordered to be withdrawn from the court of Addl. District Judge, Jalandhar and transferred to a court of competent jurisdiction at Chandigarh for disposal in accordance with law from the stage of withdrawal.
The parties are directed to appear before the District Courts, Chandigarh on 25.03.2013.
