Admittedly, in order to challenge the ex parte decree dated 7.6.1996 obtained by respondent No.1/decree holder, the objector/appellant has filed a civil suit in the Court of competent jurisdiction at Kharar. This has also been stated in para 6(m) of the grounds of appeal. Under these circumstances, no relief can be granted to the appellant in the present appeal. However, he can be granted liberty to take all the pleas available to him while prosecuting the aforementioned civil suit.

Disposed of with liberty as mentioned above.
