This matter is taken up through hybrid mode.

  1. Heard Mr. D.K. Sahoo-1, learned counsel for the petitioner.

  2. The petitioner-wife has filed this application seeking transfer of C.P. No.194 of 2019 pending in the court of learned Judge, Family Court, Angul to the court of learned Judge, Family Court, Balasore.

  3. Mr. D.K. Sahoo-1, learned counsel for the petitioner contended that the petitioner-wife was not allowed to reside within the jurisdiction of the court of Angul, as she was tortured by the members of her in-laws house. Even though she wants to survive alone, she has not been allowed to live. So, she left Angul and resides with her parental house at Balasore. It is stated that her father has died in the meantime and she is staying her mother at her parental house at Balasore. As such, there is threat to her life, if she goes to attend the proceeding at Angul. Therefore, she seeks transfer of C.P. No.194 of 2019, which is pending in the court of learned Judge, Family Court, Angul to the court of learned Judge, Family Court, Balasore in the interest of justice.

  4. Issue notice to the opposite party both in main case and interlocutory application by Registered Post with A.D. fixing a short returnable date, requisites for which shall be filed within three days.
