Heard the matter.

It is stated in the joint affidavit filed by the parties that they have in the meantime resumed their normal matrimonial relationship and are living happily and peacefully leading the marital life as husband and wife along with their daughter for whose custody the p roceeding had been initiated by the petitioner before learned Family Court, Bhubaneswar.

This writ application has been filed by the petitioner for quashment of the i nterim order passed by the said court in I.A. No. 26 of 2012 arising out of C.P. No. 65 of 201 2 on the file of learned Judge Family Court, Bhubaneswar in refusing to give custody of the da ughter to him and instead only giving him the right of visitation.

In view of the above development in the meantime that the parties have reunite d and are living happily, leading matrimonial relationship with their daughter, the writ appli cation stands disposed of as withdrawn as prayed for.

Learned counsels for the parties submit that the parties would be filing a pet ition in the similar line with the affidavit of the parties before the learned Judge Family Co urt, Bhubaneswar in CP No. 65 of 2012 for its disposal accordingly.

In case they do, the learned Judge Family Court, Bhubaneswar would do well to dispose of the matter pending before him accordingly.
