2. Mr. N. Lenka, learned counsel for the petitioner and Mr. S.S. Mohapatra, learned Additional Standing Counsel appearing for opposite party are present. Judgment prepared in separate sheets is delivered and pronounced in open Court in presence of learned counsels for the parties, and the order is passed accordingly as follows:-

3. In view of the above, this Bail Application being defective, is accordingly dismissed. It is further made clear that any of the observations made in this judgment, shall not come in the way of a fair trial of the case nor shall the trial Court be influenced by these observations. The petitioner can file a fresh Bail Application, if he is so advised.
