Learned counsel for the respondent/State referred the fact that Apache motor cycle has been recovered which was used in commission of crime as well as hand bag from possession of the applicant and two criminal cases of same nature are pending against him, then learned counsel for the applicant prays for withdrawal of the fifth bail application filed under Section 439 of Cr.P.C. with a liberty to repeat his prayer after recording of statements of material prosecution witnesses.
Prayer is accepted.
