Heard on IA No.8569/2015, which is an application under Section 379 (1) read with 482 of Cr.P.C filed on behalf of respondent No.2 Balram for suspension of his jail sentence and grant of bail.

The respondent No.2, Balram is in custody since 4.9.2015. Learned counsel for the respondents submitted that no notice has been received by the respondents. However, bailable warrant was issued against him on 17.6.2015, pursuant to which respondent Balram was arrested and produce before this Court on 4.9.2015.

It is pleaded that the respondent No.2 Balram is a 80 years old man and permanent resident of Village Bhadakhur Police Station Phoof District Bhind.

The respondents were acquitted by the JMFC, Bhind in Criminal Case No 2888/2006 vide judgment dated 1.11.2011.

On appeal the learned ASJ, Bhind in Cr. Appeal No. 421/2011 again dismissed the appeal. Failing which the

petition has been filed under Section 397 of Cr.P.C by the complainant / petitioner.

On behalf of the State, application is opposed.

Looking to the aforesaid facts and circumstances prevailing in this case, application IA No. 8569/2015 is allowed. It is directed that respondent Balram be released on bail subject to his furnishing personal bond in the sum of Rs. 25,000/- (Rs. Twenty Five Thousand only) with one solvent surety in the like amount to the satisfaction of the Trial Court, for appearance before the Registry of this Court on 07.12.2015 and on subsequent dates as may be fixed in this regard.
