Heard on I.A. No.8885/2015.
This is an application under Section 5 of the limitation act for condonation of delay in filing the present petition.
As per office calculation, the petition is barred by 156 days.
On due consideration, application (I.A. No.8885/2015) is allowed and the delay, if any, in filing the present petition is hereby condoned.
Present petition is filed for restoration of Second Appeal No.1767/2007 which has been dismissed for want of prosecution on 07.01.2015.
F o r the reasons mentioned in the petition, present petition is allowed. Consequently, S.A. No.1767/2007, is restored to its original number.
Accordingly, present MCC stands disposed of.
