This petition coming on for admission this day, Hon'ble Shri Justice Ravi

Malimath, Chief Justice passed the following:

ORDER

This petition is filed on the ground that the order dated 23.2.2021 passed in W.A. No.1189 of 2020 has been disobeyed. In terms whereof, the respondents were directed to consider the representation of the appellant.

A reply has been filed to indicate that the respondents have since filed M.Cr.C. No.22011 of 2021 before this Court, therefore, until the same is disposed off, it would not be proper to consider the representation.

On hearing learned counsels, we do not find that any contempt arises in this matter. Proceedings for contempt can be initiated if the complainant is able to show that there is willful disobedience of the order complained of. In the instant case, we do not find any willful disobedience. The respondents are entitled in law to challenge the order which they have done so. Hence, it cannot be said that there

is willful disobedience of the order.

The contempt petition is disposed off accordingly.
