Shri Atul Kumar Jain, learned counsel for the petitioner.
Shri Vivek Lakhera, learned Panel Lawyer for the respondents-State on advance notice.
Heard on I.A. No. 3105/2017 an application for condonation of delay. As per office note the review petition is barred by 67 days. Because the review petition has been filed for correction of typing error, hence, the application is allowed. The delay in filing review petition is hereby condoned.
It is contended by counsel for the petitioner that in the memo of petition filed initially, the respondent No.2 has mentioned as District Collector, (Mines) District Hosangabad, however the appropriate authority is District Collector, (Mines) District Sehore. Due to this inadvertent mistake, the order could not be executed.
In this view of the matter, review petition is allowed, where in the memo of W.P. 18900/2016, it is mentioned respondent no. 2 District Collector, (Mines) District Hosangabad be read as District Collector, (Mines) District Sehore.
