Shri Arun Dwivedi, learned counsel for the petitioner.
Shri Akshay Pawar, Panel Lawyer for the respondents/State.
Learned counsel for the petitioner submits that petitioner's case is covered by the judgment of this court passed in W.A. No.348/2008 (Usha Ranawat vs. State of MP). The respondents be directed to decide petitioner's claim by applying the principle of parity.
Learned Panel Lawyer contends that if the petitioner prefers representation, it will be decided in accordance with law.
Considering the aforesaid, the petitioner is directed to submit a representation alongwith the judgment on which reliance is placed before the respondent No. 2 to 6. In turn, the said respondents are directed to decide the representation in the light of the judgment passed in Usha Ranawat (supra) and if the petitioner is entitled to get the said benefit, benefits be extended in their favour within 90 days. If respondents decide otherwise, they shall pass a reasoned and speaking order and communicate the same to the petitioner.
The petition is disposed of without expressing any view on the merits of the case.
