Heard Mr. Apollo, learned counsel for the petitioner. Heard also Mr. Athouba Khaidem, learned Addl. PP for the State.

Mr. Apollo prays for reconstitution of the medical board as the petitioner is suffering from certain heart disease and the earlier medical board did not have any heart specialist.

On the other hand, Mr. Athouba, learned Addl. PP submits that the medical board was reconstituted which held its sitting on 23.10.2017. But, it is not clear from the records as to whether any heart specialist was a member of the State medical board.

This Court is of the view that the State is primarily responsible for the welfare and health of the detenues and in that view of the matter, this Court has felt that it may be appropriate to reconstitute the medical board in which a specialist in heart disease may be also a member which would examine the case of the petitioner, which exercise shall be undertaken by the authorities within a period of 3 (three) weeks from today.

With the above observation, the present petition stands closed.

Copy of this order may be furnished to the learned counsel for all the parties.
