Herein Pursis submitted on behalf of the Plaintiff is as follows:

1. That the Plaintiff has filed the present suit against the Defendants herein for Declaration, Injunction and cancellation of instrument. That Defendant No.412 is a Society and Defendant Nos. 1 to 411 are the flat purchasers of the Defendant no. 412 society and are signatory to the Deed of Declaration dated 16/01/2020. That the matter is pending as on today for service of summons to the remaining Defendants

3. As per the said consent terms this Plaintiff has agreed to withdraw the present suit. As such in view of the consent terms filed in the Hon'ble Bombay High Court and in view of the order passed by the Hon'ble Bombay High Court in the said writ petition this Plaintiff does not want to proceed with the said suit and hence is withdrawing present suit, without claiming costs of present suit. As such present suit may kindly be disposed off accordingly.

Hence this Withdrawal Pursis.
