ORDER

This Crl.M.C. was filed on account of the extraordinary situation of the Subordinate Courts in Kerala not functioning due to the lock down imposed. The relief claimed in this Crl.M.C. was for release of the vehicle bearing Registration No.KL 07 CP 6298 registered in the name of the petitioner.

  1. The learned Public Prosecutor Sri.M.R.Dhanil, on instructions, submit that the subordinate courts have started functioning and that since the recovery of this vehicle has already been reported to the Judicial First Class Magistrate Court-II, Ernakulam, the remedy of the petitioner is, therefore, to approach the Magistrate's Court in accordance with the provisions of the Code of Criminal Procedure, 1973.

  2. Since the stolen vehicle has been recovered, the remedy of the petitioner is before the Magistrate's Court. The courts are now functioning also.

Accordingly this Crl.M.C. is disposed of giving liberty to the petitioner to move appropriate applications before the learned Magistrate. Needless to state, if such an application is filed by the petitioner, the same shall be disposed of in accordance with law, as expeditiously as possible, not later than seven days from the date of receipt of the application.
