This Regular Second Appeal preferred against the Judgment and Decree of the Court of the Civil Judge [Sr.Dn.], Sedam in R.A No.27 of 2004 on its file dated 23rd day of March 2005 and allowing the appeal and setting aside those of the Court of the Prl. Civil Judge [Jr.Dn.], Chittapur in O.S No.69 of 1997 on its file dated 13th day of January 2000 coming on for orders on 16th day of January 2006 in the presence of Sri.Praveen Kumar Raikote, Advocate for the Appellant.

And for the reasons stated in the Judgment, it is ordered and decreed that, this Regular Second Appeal be and the same is hereby dismissed for non-prosecution.

And it is further ordered and decreed that there shall be no order as to costs in this Appeal.
