This Writ Petition is filed under Arts.226 & 227 of The Constitution of India to quash the impugned order dated 18.6.2005 passed by R-2 vide Annexure-F.
This petition is coming on for preliminary hearing in B-Group this day, the Court made the following:
ORDER
According to the petitioner, based on the recommendation of R-3 who represents Tikota Legislative Assembly Constituency, petitioner was nominated as president to the SDMC Committee of Ankalagi village of Bijapur Taluk for a period of three years commencing from 21.3.2005. Annexure-D is the order passed by R-2. The said order has been replaced by another order Annexure-E dated 27.4.2005 appointing R-3 as President of SDMC Committee. This order is called in question in this writ petition on the ground that the same is
contrary to the circular issued by the Government as per Annexure-C dated 11.8.2004. According to this circular, SDMC Committed has to be appointed for a period of three years based on the recommendation of the local MLA. Therefore, he requests that in view of Annezure-C, Annexure-F has to be quashed.

In the result, this petition is allowed. Annexure-F dated 18.6.2005 is hereby quashed.
