THESE WRIT PETITIONS ARE FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENTS TO ACQUIRE LANDS OF PETITIONERS SY.NO.1/A, 60, 56/1, 63,64, 72, 2, 1/AA, 59, 15, 17,21, 16/2 AND 17/AA ALL SITUATED AT KAREBUDUR VILLAGE, RIACHUR TALUK AND DISTRICT AND PAY COMPENSATION ACCORDING TO PROVISIONS OF LAND ACQUISITION ACT OR PAY COMPENSATION BY NEGOTIATIONS WITH PETITIONERS. DIRECT THE RESPONDENTS TO CONSIDER REPRESENTATIONS $OF$ PETITIONERS - VIDE ANNEX.B. AND C. AND ACQUIRE LANDS OF PETITIONERS AND PAY COMPENSATION.

ORDER

Though the petitions are listed in the preliminary hearing, with the consent $of$ the learned counsel for the parties, petitions are heard on merits and are being disposed of by this order.

$2.$ Petitioners are owners of lands bearing Sy.Nos.1A, $63$ , $56/1$ , $60$ , $64$ , $21$ , $1/AA$ , $15$ , $17$ , 16/2 and 72 measuring 2a.26g, 8a.11g, 2a.21g, $10a.329$ , 8a.10g, 8a, 10a.17g, 3a.36g, 5a.04g and<br>leng karebuchur Villege, Raicher Friede 1a.21g respectively. It is their case that, their lands have been sub-merged in the tank which has been constructed by the respondents though their lands are not acquired. Therefore, they submitted $^{\prime}$ B" representations vide Annexures "A" and to respondents 2 to 5 stating the relevant facts and the authorities to take immediate requested acquisition proceedings by issuing notice to them and award compensation as per law in respect of their lands.

3. Though the representations were submitted same have not been 2.8.2000 and 22.5.2000, on considered and steps are not taken for acquisition of the lands in question. Therefore, they are before this Court. The learned counsel for the petitioners Mr.Shivakumar Kaller submits that in WP 13997/87 DD 20.3.1995 directed this Court the respondents to consider their representation and take necessary steps $\mathsf{the}$ $in$ matter with certain directions at paragraph-6 sub-paras (i) $to(v)$ .

Keeping in view the directions issued in $\Delta$ . the similar writ petition, it would be proper and appropriate for this Court to allow these writ petitions with a direction to the respondents to consider the representations in terms of the directions issued by this Court in the aforesaid writ petition within four months from the date of receipt of this order and comply with the directions $\overline{a}$ given in the aforesaid writ petitions. Ordered accordingly.
