This H.R.R.P. is filed u/s.46(1) of KR Act, 1999, against the order dated 1.4.03 passed in HRC No.348/96 on the file of the II Addl. Small Causes Judge, Bangalore, allowing the petition filed u/s.27(2)(r) of KR Act, 1999, seeking eviction. This H.R.R.P. coming on for admission, this day, the court the court made the following:

ORDER

Learned counsel appearing for the parties have filed a joint memo in Court today and submit that the revision petition may be disposed of in terms of the joint memo.

  1. The joint memo reads as follows:

* The parties to the above petition submit that the matter in dispute in the above case is settled between the parties amicably at the intervention of the well-wishers of both the parties in the following terms:

  1. The petitioner/tenant undertakes to vacate and deliver vacant possession of the petition schedule premises to the respondent/landlord on or before 15.11.2004 and further submits that she has paid the rents up to that date.

  2. The respondent/landlord submits that she has received the rents from the petitioner upto 15.11.2004 and that she has no objection to grant time to the petitioner/tenant upto

15.11.2004 to vacate and deliver vacant possession of the petition schedule premises to the respondent.

Therefore under the circumstances, the parties to the above petition submit that the above petition may be disposed off granting time upto 15.11.2004 to the petitioner to vacate and deliver vacant possession of the petition schedule premises, in the interest of justice and equity."

  1. The revision petition stands disposed of in terms of the aforesaid joint memo.
