03/31.01.2017 Heard learned counsel for the parties.
The petitioners apprehending their arrest in connection with the case registered under Sections 419/420/467/468/471/120(B) IPC have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case. The petitioner No.1 was dismissed from service in the departmental proceeding.
Learned A.P.P opposed the petitioners' prayer for bail by filing counter affidavit. He referred to paragraph 28 of the Case Diary and submitted that the petitioner No.2 is not residing at Lohardaga and he is working at Kolkata for last ten years.
Having considered the facts and circumstances of the case, the above named petitioner No.2 is directed to surrender before the concerned Court below within a period of two weeks. If he surrenders before the Court below within the aforesaid period, he shall be released on bail on furnishing bail-bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of the C.J.M, Lohardaga in connection with Lohardaga P.S. Case No. 27/2016, corresponding to G.R. No. 105/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C and further that one bailer must be the permanent resident of District-Lohardaga.
In view of the allegation against the petitioner No.1, I am not inclined to grant anticipatory bail to him.
The prayer for anticipatory bail of the above named petitioner No.1 is, accordingly, rejected.
