06/24.07.2019 Mr. Krishna Shankar, learned S.C. (L&C)-II, for the respondents on verbal instruction submits that neither any writ application was preferred against the order passed by the revisional authority nor the truck has been released although the order of confiscation was set aside by the Deputy Commissioner and which was affirmed by the revisional authority.
The truck was seized in the year 2005 and in spite of the order passed by the Confiscating Authority having been set aside it is surprising to note that the truck is still lying in the Police Station. This calls for a strict action. However, before passing any order it would be necessary that the respondents file an affidavit stating the actual and correct facts. The respondents are further directed while filing the supplementary affidavit to bring on record the photographs of the present state of the vehicle bearing registration no. B.R.O. 1827.
Let this case be listed on 01.08.2019 as the first case at 10.30. A.M., under the heading "For Orders".
Let a copy of this order be handed over to Mr. Krishna Shankar, learned S.C. (L&C)-II, for the respondents and his name be also reflected in the cause list.
