Learned counsel for the appellant has submitted that I.A. No.3529 of 2019 has been filed on behalf of the appellant for withdrawal of the instant Miscellaneous Appeal as because it has become infructuous due to dismissal of Title Partition Suit No.21 of 2013.

Learned counsel for the respondents has submitted that he has no instruction that the appellant is withdrawing this appeal by filing an interlocutory application.

Considering the submissions, the instant Miscellaneous Appeal is dismissed, as withdrawn.
