Heard the parties.

  1. Learned counsel for the appellants submits that this interlocutory application has been filed with a prayer to condone the delay of 46 days in filing the instant appeal. It is next submitted that the appellants are poor rustic villagers who live in interior village and they could not immediately know about the impugned judgment, hence, the same resulted in delay in filing the instant appeal. It is further submitted that the delay caused in filing the instant appeal is neither deliberate nor intentional. It is also submitted that the appellants have very good grounds to agitate in this appeal and unless the delay caused in filing the instant appeal is condoned, the appellants will be highly prejudiced. Hence, it is submitted that the delay caused in filing the instant appeal be condoned.

  2. Considering the aforesaid facts, the delay of 46 days in filing the instant appeal is condoned.

  3. This interlocutory application stands allowed.

  1. Learned counsel for the respondents submits that this interlocutory application has been filed with a prayer to accept the Vakalatnama executed on behalf of both the respondents. It is next submitted that the respondents have executed the Vakalatnama in favour of Mr. Samir Kumar Lall, hence, the same be accepted.

  2. Considering the aforesaid facts, the prayer for acceptance of Vakalatnama on behalf of both the respondents is allowed.

  3. This interlocutory application stands allowed.
