Respondents No. 1(a) and 1(b) and 3, despite service, neither present nor represented by any counsel, hence proceeded against ex-parte.

The learned counsel for the appellant submits that he has ascertained that the sole appellant is still surviving. However, the learned counsel for the respondent submits that despite, his making communications, to, the respondents, they are not responsive, to his, communications. He further submits that awaiting a response, to, the afore communications, made by him, to the respondents, he cannot say with any firmness, that, the respondents are surviving. Hence, for the afore purpose, the matter be listed after eight weeks.
