When the matter is taken up today, the learned counsel appearing for the defendants submitted that taking advantage of the status quo Order passed by this Court, the plaintiff has not adduced any evidence. It is his contention that if the status quo is vacated, there will be expedite trial.

2. The learned counsel appearing for the fifth defendant submitted that he would like to file the written statement. It is an admitted fact that the fifth defendant is the legal heir of the second defendant. The written statement of the second defendant is already on record. Hence, the fifth defendant, as the representative of the second defendant, cannot take a different stand and she has to canvas the case of her father, which has already been filed in the form of written statement.

3. Post before the Additional Master IV for recording evidence on 08.12.2023.

4. If the trial is not not completed before 12.01.2024 by adducing evidence, the interim Order granted by this Court on 08.11.2023 will automatically stand vacated.
