PRAYER: Plaint is filed under Order IV Rule 1 of O.S. Rules read with Order VII Rule 1 of CPC, praying for judgment and decree on the following terms:

a) Directing the defendants jointly and severally to pay the plaintiff a sum of Rs.86,58,208/- (Rupees Eighty Six Lakhs Fifty Eight Thousand Two hundred and Eight Only) together with interest @ 18% p.a on the principal sum of Rs.66,75,000/-( Rupees Sixty Six Lakhs Seventy Five Thousand Only) from 25.03.2013 till the date of plaint and future interest from the date of plaint till realization;

JUDGMENT

The plaintiff and the defendants along with their respective counsels are present before this Court and submitted that the dispute between the parties has been amicably settled and Joint Memo of Compromise dated 03.10.2019 has been filed.

2. In the light of the above fact and the submissions made by the learned counsel on either side, the Civil Suit is dismissed as settled out of Court. The Joint Memo of Compromise shall form part of the decree. Registry is directed to refund the Court fee to the plaintiff as per law.

3. In view of the Joint Memo of Compromise, Registry is directed to make the payment of Rs.70,00,000/- [Rupees Seventy Lakhs only] directly to the plaintiff viz., Mr.A.Suresh. No costs.
